A 14-year-old girl died at dawn on Thursday.Dec. 28 after  being hit by  a 4×4 driven by a lawmaker on the Transístmica highway, near the community of Buena Vista, on the outskirts of the province of Colon

She had been trying to cross the road to her home at 8.00 on Wednesday evening The vehicle was driven by Mario Lázarus, CD.

She was taken by ambulance to the Nuevo San Juan polyclinic, in Colón, and then transferred to a hospital in the capital, where she died.Her death raises the total traffic fatalities for the year to 397.

Dr Lázarus said that he was driving “normally” towards his residence, about three minutes from the accident site when he felt that “something was thrown”, and he felt a blow, on the left of the vehicle, reports La Prensa.

He said that the area was very dark and everything was very fast. “At first, I thought it was an animal, but when I let the window down and moved the car,  I realized  that it  was a woman “,

I went for help and returned with my wife. The ambulance was leaving, I went to the barracks in Buena Vista, where I stayed until five in the morning “said the deputy.

Deputy Mario Lazaruz, of the opposition Democratic Change Party (CD), said in a tweet from his personal account: “I was involved in an unfortunate transit incident, on the Boyd Roosevelt road, in the Bella Vista corregimiento, where a minor lost her life.

“We have made ourselves available to the family to provide all the necessary support, as well as before the competent authority,” said Lazaruz, who as a parliamentarian can only be prosecuted by the Supreme Court of Justice (CSJ).

According to local press reports, the car that ran over the child fled but later was retained by the police. The Public Ministry (MP) said  that the Regional Prosecutor of Colón knew the case, but that “lacking competence, legal and constitutional competence  never ordered any apprehension of the deputy.” Reports El Siglo.

The MP  added that the Prosecutor’s Office of Colón “therefore did not order freedom or disengagement, and  the aforementioned (parliamentarian) was never available to the Public Ministry.”

The Office of the Prosecutor “proceeded to prevent the violation of rights and guarantees, and submitted the file of the fact, for the alleged commission of the crime Against Life and Personal Integrity to the Plenary of the Supreme Court of Justice, for that entity to continue the investigations and dispose what corresponds in law, “said the MP.

By constitutional provision, the deputies of the National Assembly (can only be investigated and prosecuted by magistrates of the Supreme Court).

The National Assembly, in turn, is the only entity with jurisdiction to investigate and prosecute the judges of the Supreme Court, which is widely regarded as a cosy deal allowing members of both entities to skirt justice.

The Plenary of Panama’s Supreme Court of Justice decided on Tuesday, January 2to admit an investigation against The CD  lawmaker  Mario Lazarus in a  case related to the running over with a car and death of a 14-year-old girl in the province of Colon.

A statement from the Judicial Body said that the  Supreme Court admitted the certification of copies from the  Public Ministry naming Lazarus for a generic crime “Against life and  personal integrity”

Magistrate of Guarantees

Lawmakers have immunity from prosecution by the Public Ministry.

Supreme Court Judge Ángela Russo, on Wednesday, January 24 presided over The reconstruction of the traffic accident involving a CD deputy that left 14-year old schoolgirl f Ruth Parreño dead in Colon in December.

Deputy Mario Lázarus- in the company of his lawyer, declared his innocence and said that the facts will be clarified.

He also asked for forgiveness from the Parreño family for the unfortunate accident. [He was reported to have left the scene of the accident]

Judge Russo is acting  as a prosecutor, as the deputy’s case has to be tried by the Supreme Court

Victor Parreño, the father of the dead girl, demanded that justice be done because “Lázarus must pay for taking my daughter away”.

Deputy in court for child traffic death

A Supreme Court imputation hearing will be held on Friday, Feb. 16 for CD  deputy Mario Lazarus, for the traffic death of a 14-year-old girl on December 27 in Colon Province.

Lazarus, a doctor. confessed at the time to leaving the scene of the accident “to get help.” He is charged with the crime against life and personal integrity.

The hearing will be chaired by the Judge of Guarantees, Harry Diaz, and the prosecutor will be the magistrate Ángela Russo, assigned on January 2 by the Plenary of the Supreme Court of Justice after the admission of the case. As a deputy, Lazarus avoids the normal criminal court system.

The mother of a 14-year-old girl watched as her daughter was hit by a vehicle whose driver wound down the window and drove away. The daughter died in hospital.

The  judge of guarantees Harry Díaz, accepted the prosecutor’s request to label the case against  Cambio Democrático (CD) lawmaker, Mario Lázarus as  aggravated homicide

The decision was taken on Friday, February 16 in an hour-long hearing in the Supreme Court (CSJ), which began at 10:35 a.m.

Magistrate Angela Russo, who is acting as the prosecutor asked the judge to rate the possible crime as aggravated homicide, after sustaining the 15 elements of conviction of the incident and death of the girl.

The abuse of the minor occurred on the night of December 27,  in Buena Vista, in Colon province.

Among the elements of conviction presented were the statements of witnesses and reports of the National Police.

Russo cited, the report of Lieutenant Fernando Archibold, from the Colon police zone who received a radio message that there was an orange  Ford Ranger in “flight”, after being involved in an “outrage”.

When he found it, he interviewed the driver, who identified himself as Mario Lázarus. and  told him that he left the scene of the accident for “nervousness”

Russo also included, as an element of conviction, the testimony of the minor’s mother who explained that she was drinking a “soda in the mini-supermarket” that night.

She said that she watched her daughter cross the street when a white vehicle gave way; but as she approached the sidewalk, an orange car rolled over her. The driver, “just lowered the window, watched and left the place.’

The prosecutor also presented a “forensic accidentology” report which shows the state of the vehicle that was driven by the deputy.

A CD Lawmaker who hit and killed a 14-year-old  girl and left the scene of the accident in Colon on December 27, without giving assistance to the victim,   has been placed under  “country arrest” by the plenary of Panama’s Supreme Court (CSJ).

The young girl was taken to a local hospital and transferred to the Hospital del Nino, where she died some four hours after the incident.

Mario Lázarus, who is a doctor and is charged with culpable homicide. must report to authorities on the 15th and 30th of each month.

His driving license is suspended and his vehicle has been impounded.

Supreme Court Judge Angela Russo de Cedeño, has completed her investigation of a lawmaker charged with aggravated manslaughter after hitting a 14-year-old girl and leaving the scene near his home in Buena Vista, Colon in December 2017.

The case attracted widespread attention as the CD deputy, Mario Lázarus is a medical doctor who gave no attention to the injured girl but headed home and returned only after she had been removed by an ambulance.

The judge transferred the indictment to the Judge of Guarantees Harry Diaz after prior transfer of the accusation to the defense.  Diaz who is on vacation will indicate the date of the oral and public hearing, which must be done within a period of not less than ten days nor more than twenty days, to discuss and decide the issues raised in the accusation.

If the petition for a summons to trial is admitted, Díaz must submit the proceedings before the Plenary of the Supreme Court of Justice, to resolve what is legally required as deputies are tried by the Supreme Court.

The Colon lawmaker Dr. Mario Lazarus facing culpable homicide charges after running over a 14-year-old girl, in Buena Vista and then driving home before returning to discover the victim had been removed by paramedics on December 27, will be tried in the Supreme Court on September 12.

After the event, the deputy issued a statement claiming to have been “involved in the traffic accident and making himself available to the family to provide all necessary support, as well as before the competent authority.”

The minor was near her house when she was  hit by the vehicle that the politician was driving.

After an agreement of economic compensation, endorsed by the judge of guarantees, Harry Díaz,  the trial against  CD Deputy Mario Lázarus in the highway death of a 14-year old girl has been suspended.

Lazarus who is a medical doctor drove to his home after hitting the victim on December 20, 2017, before returning to the scene of the accident, by which time she had been taken to hospital where she later died.

Díaz agreed to the suspension of the process for three years because all the parties agreed with the conditions of the agreement. In addition, the precautionary measure of periodic reporting was lifted.

The agreement establishes that the  Colon deputy’s driving license is suspended for three years and he must reside at the same address for the same time period.

A  judicially approved deal that  shelved  a culpable homicide charge against a CD party deputy who is a doctor and left a fatally injured  teen on the road after running her down her with his car has produced  strong reactions in citizen groups and on social media

If the deputy Mario Lázarus, fails to comply with any of the three terms in the agreement for economic compensation agreed between the relatives of the victim and his defense, the case will be reopened, said  the magistrate judge of guarantees, Harry Diaz.

Among the agreements that the deputy  must meet are: the prohibition of having contact with the parents of the victim or witnesses , the prohibition of driving any type of vehicle and not changing his current residence .

The judge dismissed the request of the prosecuting magistrate, Ángela Russo, that Lázarus be treated by  a psychiatrist and  perform voluntary and unpaid work in a hospital in Colón, as  he had 25 years without practicing medicine.

“The evidence presented by the prosecuting  magistrate show that his reactions were not of panic but a normal person,” said Diaz.

The defense of the deputy said  that the amount agreed with the relatives is kept in reserve, “the compensation was paid completely yesterday”.

Lázarus was accused of aggravated manslaughter, for the death of the minor Ruth Parreño,14,  on December 27, 2017, in Buena Vista, Colón.

Reactions
Anette Planells, of the group Movin, said  that with this agreement “I do not feel that there was justice, this example of a deputy who ran over, and fled, will add to a large number of cases in which the deputies leave unpunished.”

Freddy Pitti, from the group “Together We Decide,” said that the decision “is regrettable when citizens expected justice in a case that was emblematic.”

Pitti added that this sends a message that “if you are a person with high office or if you are wealthy you can buy justice”
